Nein zu sagen oder den Fluch der guten Tat zu vermeiden fällt nicht allen Erwerbstätigen leicht. Doch wie kann man dieser Falle risikolos entkommen?

Wer den Karren am besten zieht, bekommt die schwerste Last aufgeladen – bis ihm der Rücken bricht. Diese auch als Lastesel-Paradoxon genannte Metapher kennt auch die englische Sprache: No good deed goes unpunished. Wahrscheinlich gibt es kaum etwas, das mehr demotiviert, als Nachteile aufgrund ausgeprägter Leistungsfähigkeit zu erfahren. In den passiven Widerstand zu treten und, sei es auch nur übergangsweise, „Dienst nach Vorschrift“ zu verrichten wären allerdings nicht die besten Reaktionen. Weiterlesen

Gehaltserhöhungen zu verhandeln könnte zukünftig deutlich formaler werden. Denn durch die Entgelttransparenzrichtlinie gilt: Gleicher Lohn für gleichwertige Arbeit. Das muss nur bewiesen oder widerlegt werden.

Zugegeben, es wird ein ziemlich technokratischer Beitrag und der längste, den ich hier jemals publiziert habe. Aber für meine treuen Leserinnen und Leser dürfte sich die Lektüre lohnen, im wahrsten Sinne des Wortes. Denn obwohl Deutschland wohl erst 2027 die Entgelttransparenzrichtlinie der Europäischen Union in nationales Recht umsetzt, entfaltet sie bereits heute Wirkung, weil Gerichte den Regelungsgehalt der Richtlinie in der Rechtsprechung berücksichtigen. Deshalb sind Kenntnisse darüber vor allem für diejenigen relevant, die in naher Zukunft über Gehaltserhöhungen verhandeln. Weiterlesen

Die Bundesrepublik Deutschland hat es versäumt, bis zum heutigen Tag die EU-Entgelttransparenzrichtlinie in nationales Recht zu übertragen. Trotzdem wird sich einiges ändern, wovon in erster Linie Frauen profitieren sollen.

Ab 7. Juni 2026 wären Arbeitgeber mit mehr als 100 Mitarbeitenden dazu verpflichtet gewesen, entweder das Einstiegsgehalt oder die verhandelbare Gehaltsspanne in der Stellenausschreibung anzugeben. Oder diese Informationen vor dem Bewerbungsgespräch zu kommunizieren, beispielsweise in der Einladung zum ersten Vorstellungsgespräch. Außerdem wäre es Arbeitgebern nicht mehr erlaubt gewesen, nach der Höhe des letzten Lohns bzw. Gehalts zu fragen. Doch bekanntlich gibt es kein (Arbeits-)Leben im Konjunktiv. Weiterlesen
